Yes, this would be simply a change in the agreement when signing up for 
new members (e.g. that all posts are public domain), old members will 
have to be informed with the opportunity to  cancel. If you don't 
disagree in a certain period of time, you accept. This is not good but 
quite a usual way (see Facebook, myspace and so on). Of course the 
agreement must be in compliance with the list service provider conditions.

I think I would not do this individual-based. This would be too hard if 
you have a continuous  thread and then write a summary/translation of 
some persons who agree and some who do not. The total context may 
suffer. So this would be a general thing, I think.
