Dear Julien

Thanks you for this heads up. Very interesting.

First, having a patent doesn’t mean much – it is a license to sue and prevent competition or collect royalties. In short, a patent can exist and not be valid. To validate it, in most jurisdictions, means having a USA court agree, which costs US$180,000. They will check for “prior art”

Demonstrating “prior art” is relatively easy if it exists. A patent is only valid if it is issued to the original inventor and includes a “novel step”. If the claimed novel steps (or combinations) are copied from the public domain it is not valid. Sometimes the 20th or 25th claim on the patent is valid but is so narrow that it only applies to an extremely small sub-set of virtually identical products, and the patent holder has to prove that you are making that particular implementation.

If a producer in China was sued based on a Chinese patent, it might be upheld because the defendant could not find prior art in the public domain. Threat of a suit can be used to intimidate small producers. It is best resisted by sending them info on prior art.

You can place something in the public domain by making and selling one (1) to a member of the public. Prove that, and prior art is proven. It is by far not the only way. But it is effective.

Regards
Crispin

To get the illustrations for these patents, you have to download the respective pdf files that are in Chinese.

Just out of curiosity, how did the TLUD technology develop in China? Did Tom Reed, Paul Anderson, Crispin Pemberton-Piggot or Aprovecho lend a hand.

These patents are an example of why we should patent our stoves, even when developed as open access technology.

Are YouTube videos an economical and effective way of establishing the Worldwide precedence of an open access technology?

Cheers,
Julien
